Defamation in Cyberspace

In 2002 the Australian High Court ruled on the case of Gutnick vs Dow Jones. In its decision, the Australian High Court became the most senior court in the world to give its view on where defamation takes place over the Internet and where it should be litigated when the reader and the publisher are in different countries.

Writer of the expert technical report used in the case, Barry Hammond believes that Internet Publishing has been affected and may be subject to further limitations. The use of Web services in the future will make the issue of where defamation in Cyberspace occurs even harder to determine.
